LANDLORD FINED FOR 'WOEFULLY INADEQUATE' PRECAUTIONS AFTER FATAL FIRE

The landlord of a House of Multiple Occupation has had to pay ᆪ16,000 following a fire at one of his properties in which a tenant died. The Landlord pleaded guilty to three charges under the Management of Houses in Multiple Occupation Regulations 2006 at Cambridge magistrates court, and was found guilty of a further five charges after offering no defence to them on 13 March. He was fined a total of ᆪ10,000 plus ᆪ6,000 costs. At the time of the fire in April 2011 the house was occupied by seven individuals. The fire started in the rear first floor bedroom, resulting in the death of the occupant of that room.....read more »
 
LANDLORD SENTENCED FOR PUTTING LIVES AT RISK

A landlord in Lancaster has been sentenced for putting the lives of a family at risk by failing to arrange an annual gas safety check. The landlord was prosecuted by the Health and Safety Executive (HSE) after she failed to arrange for a registered engineer to visit one of her properties. Lancaster Magistrates' Court heard the landlord had been renting the house out to a couple and their two young children, aged five years and nine months old. An investigation was launched in April 2010 when it was discovered that gas appliances at the house had not been checked since 6 February 2009. The landlord admitted a breach of the Gas Safety (Installation and Use) Regulations 1998 for failing to arrange an annual gas safety check and was fined ᆪ750 and ordered to pay ᆪ2,250 in prosecution costs in March 2012.....read more »
 
SCHOOL FINED AFTER LOFT HATCH FALL

A School has been fined after one of its employees fell two and half metres through a loft hatch, breaking a shoulder blade and hitting her head. Magistrates' Court heard that on 29 July 2011, the member of school staff, who asked not to be named, had gone into an attic space next to her office to help a colleague folding storage boxes.....read more »
 
Myth Busters Challeng Panel Has Been Set Up By The HSE

Yesterday was the launch of a challenge panel that will scrutinise 'risk-averse' or erroneous decisions by non-regulators as another vehicle that will bring "common sense" back to health and safety. Operational from 11th April, the Myth Busters Challenge Panel, set up by the HSE will look into complaints regarding the advice given by non-regulators and seek to publicise whether this guidance reflects what the law actually requires. The Challenge panel has been created in a direct response to concerns that the reputation of health and safety is being tarnished by 'jobsworths' and cynics as an excuse to prevent essentially safe activities going ahead. FILTHY DENTAL LAB FINED FOR IGNORING HEALTH RISKS

A dental laboratory was ordered to pay £4,000 for ignoring a health and safety notice slapped on it for its 'filthy' premises that put workers at risk. A Manchester-based Dental Laboratory was served with an Improvement Notice after a Health and Safety inspector visited the site and found it to be 'extremely unclean, putting the health of workers at risk'.......read more »
 
Budget Update - De-Regulation Of H & S Legislation

The Chancellor has promised that 84 per cent of health and safety regulation will be scrapped or improved, according to this year's Budget. Last year, in its response to the Lofstedt review, the Government said it is committed to reduce health and safety regulation by more than half. The latest figure announced in the Budget takes into account last year's Red Tape Challenge, which asked the public and business for their suggestions on which laws could be amended, or revoked entirely. It is thought that "167 of the 199 health and safety regulations considered as part of the Red Tape Challenge" will either be withdrawn or improved. ....read more »

HOTEL PAYS £260,000 IN LANDMARK FIRE SAFETY TRIAL - A London hotel has had to pay more than £260,000 in fines and costs in what is believed to be the first jury trial of a case under the Regulatory Reform (Fire Safety) Order 2005. In a statement Brian Coleman, chairman of London Fire and Emergency Planning Authority said "Business owners have a clear responsibility under fire safety law to ensure that both the public and their employees are as safe as possible from the risk of fire, this verdict sends out a clear message that if these responsibilities are ignored we will not hesitate in prosecuting and people will face serious penalties."....read more »

HEALTH AND SAFETY SHOULD BE PROPORTIONATE TO RISK AND THE REGULATIONS SHOULD REFLECT THAT

Health and safety legislation is currently under the spotlight as part of the Cabinet Office's Red Tape Challenge. The HSE's Myth of the Month series ran from April 2007 to December 2010. Throughout this period, HSE attempted to dispel some of the most widely believed health and safety myths. Everything from Kids wearing goggles to play conkers to HSE banning step ladders. However there are still too many reports that HSE and health and safety law are responsible for all sorts of bans - cheese-rolling events, knitting in hospitals and even toothpicks! In reality HSE has banned very little outright, apart from a few high-risk exceptions like asbestos, which kills around 4000 people a year. Too often health and safety is used as a convenient excuse by others to not do something that may need some effort to plan and organise, but HSE say it's time to challenge this and remind people to focus on the real risks - those that are still causing people to be killed, injured or made ill at work.......read more »

Impact and advice associated with severe wind conditions - The Met Office has issued warnings that winds will cause problems as we continue through the rest of this week. They have issued a 'Be Aware' status, which is likely to be upgraded as the week progresses. The worst weather hitting the country, Thursday and Friday this week. Obviously you need to take into consideration any employees you may have on the road, out on site visits and any temporary or out house premises you may have. You will need to take especial care where there is scaffolding or loose site materials etc. on and around your premises. A fine of £ 10,000 plus £ 12,759 costs has been imposed on the University of Lincoln after evidence of the existence of asbestos-containing material throughout the University came to light. It was only by chance that the situation came to light. In February 2010, a lecturer found herself accidentally locked in a room at the University, on freeing herself she had noticed a dusty material which looked odd and contacted the health and safety department to investigate further. The landlord, was found guilty of breaching Regulation 33(1)(g) of the Health and Safety at Work etc. Act 1974 and Regulation 36(3) of the Gas Safety (Installation and use) Regulations 1998.
